Terms and Conditions of Sale and Entry | Donmar Warehouse

MEMBERSHIP

Thank you for supporting the Donmar Warehouse.

These are the terms and conditions which apply to your Donmar Warehouse Membership (‘these Conditions’). By purchasing or renewing a Membership with Donmar Warehouse, You are agreeing to be bound by these Conditions.

1.         DEFINITIONS

In these Conditions:

  • Applicable Laws’ means all laws, regulations, regulatory requirements and codes of practice applicable to either party or to the existence or operation of these Conditions from time to time.
  • Donmar Warehouse’,‘the Donmar’ and ‘the Theatre’ (and ‘we’, ‘our’, ‘ours’ and ‘us’) refers to the Donmar Warehouse Projects Limited, registered charity number 284262, Donmar Warehouse, 3 Dryden Street, London, WC2E 9NA;
  • Membership’ means the contract between us in accepting Your offer to purchase specific Benefits, with an optional donation, from the Donmar;
  • Gift Membership’ means a Membership where the specific Benefits are purchased for a designated person other than You;
  • Membership Level’ means the specific Level of Membership You have purchased, including Friend (recurring donation) £75, Friend (one-off) £85, Best Friend, Bronze Patron, Silver Patron, Gold Patron, Platinum Patron;
  • Membership Card’ means the digital card which is issued to You by the Donmar or a trusted third party following the purchase or renewal of a Friend, Best Friend, Bronze Patron, Silver Patron, Gold Patron or Platinum Patron Membership;
  • Accepting’ means either confirmation by the Donmar verbally or in writing (including by email) that Your Membership application has been received and Your Benefits will commence;
  • Benefits’ means those products and services offered to You by the Donmar pursuant to these Conditions as part of a Membership;
  • Personal Information’ refers to all personal data relating to an identifiable person who can be directly or indirectly identified in particular by reference to an identifier; and
  • You’ or ‘Your’ means you or anybody who in our reasonable opinion is acting with your authority or permission.

2. HOW THE CONTRACT IS FORMED BETWEEN YOU AND THE DONMAR

2.1. After placing an order, You will receive a confirmation email from us acknowledging that we have received your order. The contract between us will be formed when we send you an acknowledgement email or letter which confirms our Acceptance of Your offer to purchase a Membership.

3. BENEFITS

3.1. As a member You are entitled to the Benefits listed on the relevant page of our website, subject to availability of the Benefits and these Conditions. The Donmar reserves the right to make changes to these Conditions including to the Benefits. We may make minor changes to reflect any changes in relevant laws or to implement adjustments that will have no significant effect on Your Benefits.

3.2. Membership does not guarantee access to tickets for productions at the Donmar, or our West End Transfers, and ticket limits may apply. Priority booking applies to events selected by the Donmar in its sole discretion.

3.3. Benefits are for the personal use of the Member(s) only. Benefits, including priority booking, late access to house tickets, events and invitations are non-transferable and non-refundable. If the information available to us suggests that You have used Your Benefits for commercial gain (e.g. reselling tickets purchased during priority booking periods) we may, at the Donmar’s complete discretion, cancel Your Membership without notice or refund.

3.4. Invitations to member events are intended for the invitee (Membership holder) and a guest(s) only as stipulated. For Supporters’ Evenings , Patrons may be able to purchase two additional tickets, additional to the allocation as listed in their Benefits, subject to availability and at the Donmar’s discretion. For Bronze and Silver Patrons, the maximum number of tickets is four (subject to availability). For Gold and Platinum Patrons, the maximum number of tickets is six (subject to availability). These limits may be amended on individual basis at the Donmar’s sole discretion.

3.5. All Benefits must be redeemed during the Membership period specified in clause 3.6 and cannot be applied following the expiration of the Membership retrospectively unless specifically granted by the Donmar at our discretion.

3.6. Memberships are valid for 12 months:

      3.6.1. Memberships (other than Gift Memberships) are valid from the date of purchase or renewal; and

      3.6.2. Gift Memberships are valid from the date of activation and can be activated within 12 months of the date of issue, or renewal, as stated on the voucher, subject to any longer period as specifically granted by the Donmar at our discretion.

3.7. You may upgrade Your Membership at any point during the duration of Your existing Membership. You may cancel Your Membership at any time, at which point the existing Membership will end on the expiry date, 12 months from the date of original purchase, or where it is auto-renewal, 12 months from the date of such auto-renewal, unless specified otherwise for Memberships purchased on a monthly, quarterly or bi-annual basis.The process of both upgrading and cancelling Memberships is managed at the discretion of the Donmar, in accordance with our refunds policy as referenced in clause 6.1. 

3.8. We reserve the right to, if necessary, revoke Membership without refund if an individual breaks the Conditions of Membership, ticket sales or entry, or behaves in a threatening, abusive or otherwise inappropriate manner towards any person at the Donmar, damages or threatens to damage any property of the Donmar or other venue of a Donmar Warehouse event, or acts in a manner which – in the Donmar’s sole opinion – brings the Theatre into disrepute.

4. GIFT MEMBERSHIPS

4.1 Gift Memberships cannot be redeemed for cash and change will not be given. Cash refunds shall not be available under any circumstances.

4.2. Gift Memberships may not be applied to the payment of tickets.

4.3. Gift Membership Vouchers are valid 12 months from the date of purchase. Donmar Warehouse reserves the right to restrict the use of Gift Memberships in the event of exceptional circumstances.

5. PAYMENT AND PRICE

5.1. The price of Memberships will be as quoted on the Membership page on our website: Membership | Donmar Warehouse. All prices are inclusive of VAT. 

5.2. Payment for Memberships may be made by Credit Card (American Express, Mastercard or Visa), Debit/Bank Card, Cheque, Bank Transfer, or Direct Debit. We can only accept CAF Account or Charitable Trust payments for the donation element of Memberships.

5.3. All Memberships are available to be paid monthly, quarterly or annually. Our Friends £75 Membership Level is solely available for those who pay on a recurring annual basis when paying with Continuous Payment Authority, or monthly, quarterly or annually when paying by Direct Debit. 

5.4. If You choose to pay by annual Direct Debit, You will be notified of our intention to debit Your account in advance of the annual due date. If there is any difficulty with collecting the Direct Debit payment the Donmar will be in touch to re-attempt payment collection.

5.5. You can cancel a Direct Debit at any time by writing to Your bank or building society, or through their online banking portal, if provided. Please also send a copy of Your notification to us.

5.6. If You choose to auto-renew, payments will be taken by Direct Debit or Credit Card payments (sometimes known as Continuous Payment Authority or CPA) where we will ask You to allow the same amount to be debited from Your card automatically at a fixed interval. 

 5.7. You can cancel a Continuous Payment Authority any time by logging into Your Donmar account and unticking the ‘auto-renew’ box which appears next to Your active Membership. Payment will be taken 2 days before Your Membership is due to expire, and You will receive an email notification of this upcoming payment 10 days before this payment will be taken (12 days before the Membership expiry date). You can cancel Your automatic renewal by emailing friends@donmarwarehouse.com before the payment collection date. We won’t retrospectively refund the Membership fee  once the Membership has automatically renewed.  

5.8. The Donmar reserves the right to change the price of a Membership at any time, although any such change to fees will not come into effect until the expiry of Your current subscription term. We will notify You if there is a change in the price of a Membership and we will give You at least 10 working days’ notice of the change. 

6. OUR REFUNDS POLICY

6.1. Donations made to the Donmar are non-refundable in accordance with Applicable Laws. Donations made through other platforms are subject to their terms and conditions.

 6.2. You have the right to cancel a Membership within 14 days of purchase for a full refund of your Benefits. However, if You have used any Benefits (including the opportunity for early booking) prior to cancellation, You must pay the value of the Benefits used.

6.3. We are unable to offer any refunds in respect of any Membership You purchase except as provided in clause 6.2.

6.4. We have no liability for any unused Memberships, and Benefits cannot be applied after the Membership expiration date has passed.

7. OUR LIABILITY

7.1. If, in providing the Membership to You, the Donmar fails to comply with these Conditions, the Donmar is responsible for loss or damage You suffer that is a foreseeable result of the Donmar’s breach of these Conditions or the Donmar’s negligence, but the Donmar is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of the Donmar’s breach or if it was contemplated by You and the Donmar at the time You purchased the Membership.

7.2. We do not in any way exclude or limit our liability for:

      7.2.1. death or personal injury caused by our negligence;

      7.2.2. fraud or fraudulent misrepresentation;

      7.2.3. any other liability which cannot be limited by law.

8. DATA PROTECTION

8.1. Detailed information about how we process personal information about You can be found in the Privacy Policy.

9. GIFT AID

9.1.All Memberships include a payment for Benefits and a donation amount which is eligible for Gift Aid. The amount eligible for Gift Aid can be found on the relevant Membership web page.

9.2. Memberships purchased as a gift for someone else are not eligible for Gift Aid and cannot be included in self-assessment tax returns. 

9.3. Gift Aid can only be claimed on the Membership donations when we have a valid Gift Aid declaration on file. You can make a declaration in writing or verbally to a member of the Donmar Warehouse (which we will confirm in writing). 

9.4. To be eligible for Gift Aid You must be a UK taxpayer and have paid at least the same amount of UK income tax or capital gains tax as we (and any other charitable donations for which You claim relief) would reclaim on Your donation.

11. GENERAL

11.1. The Donmar’s website may contain hyperlinks to websites operated by parties other than the Donmar. The operation of such websites is outside the Donmar’s control and You proceed at Your own risk. The Donmar does not endorse or sponsor and is not liable for the products, services or content You access through any linked site.

11.2. Only You may enforce these Conditions.

11.3. All the terms of which apply to Your Membership are contained or are referred to within these Conditions.

11.4. If any part of these Conditions are held to be unenforceable this will not affect the enforceability of the remaining provisions.
